Server Hosting Terms of Service

The terms and conditions governing your relationship with us upon purchasing and using any hosting service (VPS / VDS / Dedicated / Storage / Windows / Shared).

1. Definitions & Acceptance

In this Agreement, unless the context otherwise requires:

  • "Provider" / "We" / "Company": SuperCode — Palestine.
  • "Customer" / "You": The natural or legal person purchasing the Service.
  • "Service" / "Server": Any hosting product including VPS, VDS, Dedicated, Storage VPS, Windows VPS, Shared Hosting, or any cloud service offered.
  • "Data": Any content stored by the Customer on the Service — files, databases, configurations, software.
  • "Business Day": Weekdays Sunday–Thursday, excluding official holidays in Palestine.

Completing a purchase means acceptance of all terms of this Agreement.

2. Description of Service

The Provider supplies hosting infrastructure comprising:

  • Compute resources (CPU, RAM, storage, bandwidth).
  • One public IPv4 address (unless otherwise specified).
  • An operating system initially installed based on the Customer's selection at purchase.
  • Full administrative access (root/Administrator) for the Customer.
  • A control panel to manage the subscription (start, stop, reinstall, renew).

The Provider's offering is limited to the infrastructure above. It does not include consulting, programming, administrative, or technical support for software and applications.

3. Payment & Renewal

3.1 Prepayment

All services operate on a prepaid basis. The full amount for the billing period (monthly or annual) is paid before service activation.

3.2 Renewal Dates

The renewal date is calculated automatically from the initial activation date. The Customer receives email reminders 7, 3, and 1 day(s) before the due date. Non-receipt of a reminder does not exempt the Customer from paying on time.

3.3 Late Payment

If the renewal amount is not received within 24 hours of the due date, the service is suspended, and the server and its data are deleted 48 hours after the due date. No refunds are issued and no additional grace period is provided.

3.4 Payment Methods

Payment is made through the payment gateways available on the site (credit cards via Lahza, PayPal, or bank transfer with prior Provider confirmation).

3.5 Refunds

No refunds are issued for payments after the service has been activated, whether used or unused.

3.6 Additional Fees

Payment gateway fees (Lahza, PayPal, bank fees) and local taxes are borne by the Customer and are not deducted from the service amount.

4. Customer Responsibilities

The Customer is responsible for everything related to their server after delivery. These responsibilities include:

  • Operating system administration: updating, patching, configuring, and upgrading when needed.
  • Installation and administration of all software and applications (Nginx, Apache, MySQL, Node.js, cPanel, etc.).
  • Managing accounts and passwords, and protecting them from leaks.
  • Taking regular backups of your data and storing them independently from the server.
  • Monitoring the server: performance, usage, disk space, logs.
  • Configuring the firewall and protection against intrusions.
  • Complying with local and international laws in all content published or software run on the server.
  • Acquiring licenses for any commercial software installed on the server.
  • Managing DNS records for any domains associated with the server.
  • Responding to any abuse reports within 24 hours.

The Customer is the party authorized to access their server. Failure to perform any of the responsibilities above does not create an obligation on the Provider to perform them on the Customer's behalf.

5. What Is Not Included in the Subscription

The Customer acknowledges that the subscription does not include the following services:

  • Programming services: the Provider does not program websites, applications, or scripts on behalf of the Customer.
  • Server administration: no managed service is provided — all administration is performed by the Customer.
  • Software installation: the Provider does not install software (WordPress, cPanel, databases, etc.) on the Customer's behalf.
  • Application technical support: issues with operating systems, software, and applications are the Customer's responsibility.
  • Data recovery: the Provider does not offer data recovery services in case of deletion.
  • Automatic backups: unless purchased as an add-on, the Provider does not perform backups of Customer data.
  • Security auditing: the Provider does not audit the security of the server or installed applications.
  • Password recovery: passwords are the Customer's responsibility. The Provider does not retain them.

If the Customer requires any of these services, they may be contracted as a separate service with fees independent of the subscription.

6. Prohibited Uses

The following uses of the server are not permitted:

  • Sending unsolicited messages (spam) via email or SMS.
  • Denial-of-service attacks (DoS / DDoS) — whether as origin or target.
  • Attacking other systems, port scanning, or any hacking activity.
  • Hosting illegal content: child abuse material, terrorist content, incitement, racism.
  • Violation of intellectual property rights (publishing copyrighted material).
  • Fraud, deceiving users, phishing sites.
  • Cryptocurrency mining on shared servers or standard VPS plans.
  • Hosting public proxies, Tor exit nodes, or commercial VPN services without prior approval.
  • Conducting activities that violate Palestinian or international laws.

Discovery of any prohibited use results in suspension of the service, and may be followed by deletion and reporting to authorities when applicable.

7. Suspension & Termination

The Provider reserves the right to suspend or terminate the Service in the following cases:

  • Late payment (as per §3.3).
  • Violation of any prohibited use (§6).
  • Receipt of documented abuse reports.
  • Abuse of Provider resources.
  • Official request from a competent judicial authority.
  • Providing false or misleading information at registration.

The Customer may cancel the subscription at any time from the control panel. Cancellation takes effect at the end of the current paid period.

8. Data Deletion After Cancellation

Upon termination of the subscription, the server and all its data are permanently deleted.

  • There is no retention period for Customer data after cancellation.
  • Deletion is technically irreversible (secure wipe).
  • The Customer is responsible for taking backups prior to the cancellation date.
  • Re-subscribing after deletion = creating a new empty server, not restoring the previous one.

9. Backups

Taking backups is the Customer's responsibility. The Provider does not perform automatic backups unless purchased as an add-on.

It is recommended to:

  • Take at least daily backups.
  • Store the backup in a location independent from the server (different cloud or local machine).
  • Test restoration periodically.

In the event of data loss for any reason, the Provider does not assume responsibility for recovery.

10. Security & Protection

The Customer is responsible for their server's security and the protection of stored data. This responsibility includes:

  • Choosing strong passwords and rotating them regularly.
  • Enabling two-factor authentication (2FA) wherever possible.
  • Updating the operating system and software upon release of security updates.
  • Configuring a firewall and appropriate network rules.
  • Using SSL/TLS for sensitive communications.
  • Monitoring system logs for suspicious activity.

The Provider offers basic infrastructure protection (network Anti-DDoS, physical data center security). Protection of the operating system, applications, and data is the Customer's responsibility.

11. Service Level Agreement (SLA)

The Provider targets 99.9% annual uptime for network and power infrastructure, with the following exclusions:

  • Scheduled maintenance (announced in advance).
  • Outages caused by Customer actions (misconfiguration, software installation, incorrect commands).
  • Public internet outages or upstream carrier disruptions.
  • Force majeure (§14).

If availability drops below the stated threshold due to reasons attributable solely to the Provider, the Customer is entitled to have their subscription extended by the lost time — up to a maximum of 5% of the monthly period value.

12. Limitation of Liability

To the maximum extent permitted by law, the Customer acknowledges and agrees that:

  • The Provider makes no express or implied warranties on the Service, which is provided "AS IS".
  • The Provider's maximum liability for any claim shall not exceed the amount of the single most recent monthly fee paid for the disputed service.
  • The Provider is not liable for indirect or consequential damages (lost profits, lost opportunities, lost data, business losses).
  • The Provider bears no responsibility for Customer content, their use of the server, or the actions of users they engage with.

13. Indemnification

The Customer agrees to indemnify, defend, and hold harmless the Provider, its employees, and partners from and against any claims, losses, damages, or legal costs arising out of:

  • The Customer's violation of any term of this Agreement.
  • Any content or activity published or executed by the Customer on the server.
  • Infringement of third-party rights (intellectual property, privacy, defamation).

14. Force Majeure

The Provider shall not be liable for any delay or failure to render the Service due to causes beyond its reasonable control, including: wars, occupation, unrest, natural disasters, public internet outages, large-scale cyber attacks, pandemics, government decisions, public infrastructure failures.

15. Changes to Terms

The Provider reserves the right to modify this Agreement at any time. Changes are published on this page, and the Customer is notified via email 7 days prior to their effective date. Continued use of the Service after the change takes effect constitutes acceptance.

16. Governing Law & Jurisdiction

This Agreement is governed by and construed in accordance with the laws in force in the State of Palestine. Any dispute arising out of this Agreement shall be under the exclusive jurisdiction of the competent courts in Nablus Governorate, Palestine.
