SMS Services Terms of Service

The terms and conditions governing the use of bulk SMS messaging services via the SuperCode platform.

1. Definitions & Acceptance

  • "Provider" / "We": SuperCode — Palestine.
  • "Customer" / "You": The person or entity using the SMS service.
  • "Message": A short text message sent via telecom networks to one or more phone numbers.
  • "Sender ID": The name or number displayed to the recipient as the sender of the message.

Creating an account or purchasing message credit means acceptance of this Agreement.

2. Description of Service

The Provider offers a platform for sending short text messages (SMS) to telecom networks in Palestine and other countries, with a control panel for managing campaigns, lists, and reports.

  • Sending individual messages or bulk campaigns.
  • Managing and organizing recipient lists.
  • Scheduling messages for later delivery.
  • Delivery status reports (Delivered / Failed).
  • API for integration with external systems.

3. Account & Balance

The service operates on a prepaid balance system. The Customer purchases a message credit, and each sent message is deducted from the balance.

  • A single message is counted based on text length (160 Latin characters or 70 Arabic characters = one message).
  • Longer messages are split into multiple parts, with credit deducted for each part.
  • Messages sent to other countries may have different pricing depending on the destination.
  • Balance does not expire on a specific date, but accounts inactive for over 12 months may be closed with credit forfeiture.

4. Sender ID

The Sender ID is the name or number displayed to the recipient. It is subject to verification and approval before activation.

  • The name must be linked to the Customer, their company, or their product.
  • Using names of other companies or trademarks not owned by the Customer is not permitted.
  • Sender ID approval may take from 1 hour up to 3 business days.
  • Telecom carriers may reject certain names for their own reasons, and the decision is final.
  • Misuse of a Sender ID results in its immediate revocation.

5. Message Content

The Customer is solely responsible for the content of messages they send. The Provider does not automatically review content in advance, but reserves the right to inspect it at any time.

  • Messages must be clear, truthful, and non-misleading.
  • The sender's name (company name) must be included in the message content.
  • Marketing messages must include an opt-out method.
  • The Provider may decline to send certain content without stating reasons.

6. Message Delivery

The Provider makes best efforts to deliver messages promptly, but delivery depends on intermediate telecom networks and is not guaranteed at 100%.

  • Messages may be delayed during peak times or telecom network outages.
  • Invalid numbers, switched-off phones, or out-of-coverage = message not delivered, but credit is still deducted (as the effort was made).
  • Delivery reports may sometimes be delayed or inaccurate, attributable to telecom carriers.
  • No refund is issued for credit consumed in send attempts, even if the recipient did not receive them.

7. Prohibited Uses

Sending the following types of messages is not permitted:

  • Fraudulent messages, phishing, or impersonation.
  • Illegal, pornographic, racist, inciting, or morally offensive content.
  • Marketing of illegal drugs or prohibited substances.
  • Sensitive political content without official authorization.
  • Messages containing links to malicious sites (malware, phishing).
  • Sending to numbers whose owners have not consented to receive marketing messages (spam).
  • Violation of intellectual property or privacy rights.

8. Anti-Spam Policy

The Provider is committed to combating unsolicited messages. Marketing messages must:

  • Be sent only to numbers whose owners have explicitly consented to receive them (opt-in).
  • Include a clear method to unsubscribe.
  • Be sent at appropriate times (recommended to avoid 10 PM–8 AM).
  • Respect official Do Not Disturb (DND) lists.

The Provider reserves the right to suspend any account that receives documented spam reports, without refunding remaining credit.

9. Suspension & Termination

The Provider may suspend or terminate the account in the following cases:

  • Violation of any term of this Agreement.
  • Receipt of documented spam reports.
  • Using the service for fraudulent or illegal purposes.
  • Official request from a judicial authority or telecom carriers.
  • Inactivity for more than 12 months.

10. Fees & Refunds

  • Message pricing is shown in the control panel and may change based on telecom carrier rates.
  • No refund for purchased credit after activation, whether used or unused.
  • Credit consumed for undelivered messages is not refunded.
  • Payment gateway fees are borne by the Customer.

11. Limitation of Liability

  • The service is provided "AS IS" without express or implied warranties.
  • The Provider is not liable for damages arising from message non-delivery, delay, or content.
  • The Provider's maximum liability shall not exceed the value of the Customer's most recent credit purchase.
  • The Customer bears full legal responsibility for the content they send.

12. Governing Law

This Agreement is governed by the laws of the State of Palestine. Any dispute shall be under the exclusive jurisdiction of the competent courts in Nablus Governorate, Palestine.

13. Contact

By creating an account or purchasing message credit, you acknowledge that you have read and accepted the terms of this Agreement.
